WAQF Amendment Act Supreme Court Verdict

Dear Friend,

  1. Power to De-Notify Waqf by Usage:

  2. Non-Muslim Members in WAQF Council:

  3. DM’s Power to Remove WAQF Status Post-Complaint:

Kapil Sibal Ji

Interim Stay

Dear Friend,

FAQs with Detailed Answers – WAQF Amendment Act & Supreme Court Verdict

1. What is the WAQF Act?

The WAQF Act is a law passed by the Indian Parliament to regulate and manage Muslim religious and charitable endowments called waqf. It defines how waqf properties are to be governed and managed by the WAQF Board in each state.

2. What is a WAQF property?

A WAQF property is any immovable or movable property that has been permanently dedicated for religious, pious, or charitable purposes under Islamic law.

3. What does “WAQF by usage” mean?

It refers to properties claimed as waqf not through documentation or legal title, but through usage over time — e.g., if namaz was being offered regularly there, it could be declared as waqf by use.

4. Why was the WAQF Amendment Act brought in?

The 2013 amendment aimed to increase the powers of the WAQF Boards, simplify property management, and prevent encroachments. However, it gave WAQF boards sweeping authority, triggering disputes.

5. What are the main controversies around WAQF properties?

The biggest controversies involve ownership disputes, lack of documentation, claims over public or private lands, and the unchecked expansion of waqf properties without clear historical proof.

6. What did the Supreme Court say about the WAQF Amendment Act?

The Supreme Court refused to grant a stay on the WAQF Amendment Act and advised that challenges to the law must be backed by solid constitutional arguments and not just emotions.

7. Did the Supreme Court grant interim relief?

No, as of the latest hearing, no interim relief or stay has been granted by the Supreme Court against any provision of the WAQF Amendment Act.

8. What were the 3 main issues discussed in court?

  1. Power to De-Notify WAQF by usage

  2. Inclusion of non-Muslim members in WAQF Council

  3. Power of DM to cancel WAQF status post-complaint

9. Can the government de-notify a WAQF property?

Yes, under the recent law, the government can de-notify a property claimed as waqf if proper inquiry finds it lacks valid waqf documentation or title.

10. What role does the DM (District Magistrate) play in WAQF disputes?

If a complaint is received, the DM can inquire and cancel the waqf status of a property based on evidence, subject to legal procedures.

11. Why were Kapil Sibal and Abhishek Manu Singhvi criticized?

Because they argued emotionally in court without providing solid, structured legal evidence that proves the Act violates constitutional rights.

12. Was any part of the WAQF Amendment Act declared unconstitutional?

No. The Supreme Court reiterated that laws passed by Parliament are presumed constitutional unless proven otherwise with factual evidence.

13. What is the Supreme Court’s stance on WAQF by usage?

The court questioned how WAQF Boards claimed properties as waqf merely by usage without registration or ownership proof.

14. Why was 2013 mentioned in the hearing?

Because there was a sudden spike in waqf property registrations post-2013. The court asked why properties were not registered earlier if they were truly waqf since 1954.

15. What is the importance of registration of WAQF properties?

Registration provides legal clarity, prevents disputes, and ensures that public and private lands are not misclassified as waqf.

16. Is it mandatory to register a WAQF property?

Yes. Under the WAQF Act, registration is essential for a property to be officially considered waqf.

17. What is the ASI angle in this case?

Court said that bringing a waqf structure under the Ancient Monuments and Archaeological Sites and Remains Act (ASI) does not impact religious practices there.

18. Can religious practices continue at ASI-protected sites?

Yes. The court cited examples like Khajuraho temples where religious practices continue despite ASI protection.

19. Is there a risk of mosques being taken over under ASI Act?

No, unless the structure is of national importance or historic value. Even then, religious practices are not banned.

20. Why is this case significant for Hindu and non-Muslim communities?

Because many properties, including temples and public lands, have allegedly been wrongfully claimed by WAQF Boards without proper legal basis.

21. Is the WAQF Board a government body?

No, it is a statutory body under the WAQF Act. It operates under the Ministry of Minority Affairs but is not a government department.

22. Who controls WAQF Boards?

They are controlled by state governments and regulated by the Central WAQF Council under the WAQF Act.

23. Can a common citizen challenge a WAQF claim?

Yes. Any individual whose property is wrongfully declared as waqf can challenge it in court or submit a complaint to the DM.

24. Has WAQF misused its powers in the past?

Numerous allegations exist about WAQF Boards claiming lands arbitrarily and being involved in land mafia-style encroachments.

25. What is the WAQF land issue in Uttar Pradesh?

There have been reports of massive illegal land claims by the WAQF Board in UP. The government has begun bulldozer actions on illegal encroachments.

26. Can WAQF property be sold or transferred?

No. WAQF properties are permanent endowments and cannot be sold, mortgaged, or transferred.

27. Why is there so much secrecy around WAQF land records?

Because many properties were claimed without public notice or proper registration, leading to lack of transparency and public backlash.

28. What’s the current status of the Supreme Court case?

Arguments are still ongoing. No provision of the Act has been stayed. Next hearing will further examine constitutionality and evidence.

29. What should affected property owners do?

They should gather original land records, challenge false WAQF claims in court, and file complaints with local administration if needed.

30. What is the public takeaway from this case?

The judiciary is firm – emotions don’t win cases, evidence does. Property rights must be defended with law, not just speeches. Public must stay aware and alert.
